Annual compliance website review

The Centers for Medicare and Medicaid Services (CMS) requires health plans to ensure third-party marketing organization (TPMO) websites are compliant with CMS requirements. TPMOs are organizations and individuals, including independent agents and brokers, who are compensated to perform lead generation, marketing, sales, and enrollment-related steps as part of a beneficiary’s enrollment process (e.g., from initially becoming aware of a Medicare Advantage or Part D plan to eventually making an enrollment decision).

This requirement affects Dean Health Plan only because Prevea360 Health Plan no longer offers Medicare Advantage plans.

In ongoing compliance with CMS website requirements for TPMOs:
  • Scope – We review websites that reference or display Dean Health Plan Medicare Advantage products, company name, logo, or link to the Dean Health Plan website.
    • Websites with marketing content need to be submitted to CMS on an annual basis (contract year) and must include the current Material ID on all web pages and appropriate disclaimers. If CMS filing is needed, we’ll advise you on next steps.
    • New this year — the following updated disclaimer must be prominently displayed on your website (unless you sell all commercially available Medicare Advantage and/or Medicare Part D plans in a given service area):
“We do not offer every plan available in your area. Currently we represent [insert number of organizations] organizations which offer [insert number of plans] products in your area. Please contact Medicare.gov, 1–800–MEDICARE or your local State Health Insurance Program for information on all of your options.”

This disclaimer should comply with all other accessibility requirements that may be applicable to required information.
 
  • General reminders:
    • Use of the Medicare name, CMS logo, and products or information issued by the federal government, including the Medicare card, in a misleading way is prohibited. Use of the Medicare card image is permitted only with CMS authorization.
    • Implying or stating that a Medicare Advantage or Medicare Cost plan operates as a supplement to Medicare is prohibited.
    • Implying or stating that plans are only available to seniors rather than to all Medicare beneficiaries is prohibited.
    • If you don’t have the new Dean Health Plan by Medica logo, contact Natasha Cook at natasha.cook@deancare.com to request the image you need to update your website.
 
  • Follow the process below to request to have Dean Health Plan information on your website reviewed:
    • Email your website URL and your name and agency name no later Apr. 5, 2024: DHP.SBU.Managers.supervisors@deancare.com
    • We’ll follow up to the request by reviewing your website and provide comments about the Dean Health Plan brand and CMS guidelines.
    • Notify us of any changes to your web pages with Dean Health Plan information in the future to start a new review process.
